Judge Winikow is based in Los Angeles County. He charges a flat rate of $18,000 for a basic two-party case, and $20,000 for class action/PAGA cases, both of which include all preparation and reasonable follow up in addition to a full day's mediation session. Judge Winikow will adjust the rate for cases outside of Los Angeles, Orange and Ventura counties (unless the mediation is conducted via teleconference,) as well as for cases involving multiple plaintiffs, separately represented defendants or complex matters. The mediation fee does not include any additional charges for securing mediation space if the parties cannot host the mediation. Please email to discuss any rate adjustments that might apply.
All mediation fees are due in full upon booking. Dates cannot be secured unless fees are deposited in advance. Mediation fees will be refunded, in full minus a $1,000 booking fee, if parties cancel more than 30 days in advance of the scheduled mediation. Mediation fees will not be refunded if the parties cancel within 30 days of the scheduled mediation -- unless Judge Winikow can re-book that date with another case. Because Judge Winikow cannot book multiple matters on the same date, and must reserve adequate time for preparation and follow up on all matters, parties seeking to simply continue a mediation (as opposed to cancelling it outright) will still be responsible for payment of the fee for the original date if it is taken off calendar within the 30 day window period. Cancelling party will be responsible for full payment unless the date is re-booked.
